OBJECTIVE

As a user, you are obliged to read and understand these terms and conditions (“Terms”) before accessing the website / mobile application.

By registering with Nahar Credits Private Limited (“we” or “us” or “our” or the “Company”) and/or by using or attempting to use any of the Company’s services directly or indirectly (“Service(s)”), you understand and agree that we will treat your use of the Services as acceptance of these Terms from that point onwards.

SERVICES

You may browse, check, and avail various products/services which are available through the Company’s website or check new/pre-approved offers available to an existing user for availing Services.

You hereby understand and acknowledge that we may request some information from you when you visit our web portal/ mobile application from time to time, including for the purposes of complying with various applicable laws, regulations and guidelines (including Know Your Customer (KYC) norms / Anti-Money Laundering (AML) standards / Combating of Financing of Terrorism (CFT) / Prevention of Money Laundering Act, 2002) and Central KYC Registry, CIC or any other regulatory authority, by the Company or its associated partners within the ambit of applicable laws. You further acknowledge that if you do not provide the requested information to the Company, the Company or its partners will be unable to provide or continue its / their services to you.

You hereby understand that when you apply for a loan, the Company may check your records amongst other things with its own records, any information as available to the Company through any of its sources, those at credit reference agencies (CRAs); those at fraud prevention agencies (FPAs) for assessing your credit worthiness, verifying identity to prevent and detect crime and money laundering.

You hereby understand and acknowledge that the Company has a policy as per which applicable rate of interest is determined based on various types of risks, cost of funds, tenor of loan, amount of loan, etc. You understand thatthe rate of interest may differ from customer to customer and from loan to loan. You acknowledge that We reserve the right to reject any credit application without assigning any reasons whatsoever and without any intimation to you.

You hereby give your express and unequivocal consent to Us to retrieve/ procure/download KYC data/ details from Central KYC registry for the purposes of verifying/establishing the data/details/identity. You hereby further acknowledge that We/ any of the agents or representatives may check the details that you have supplied against any particulars available with the Central KYC registry.

You hereby acknowledge that you understand the English language and are most comfortable receiving communications in the English language.

INTELLECTUAL PROPERTY RIGHTS

The Company’s website and the mobile application Services are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the website may be copied, reproduced, republished, uploaded, posted or distributed in any way without the Company’s express written permission. When you upload, submit, store, send or receive content that may include feedback to the Company, you give the Company a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the Company’s Services, and to develop new ones. This licence continues even if you stop using the Services.

You hereby acknowledge, understand and consent to the terms contained in the Company’s “Privacy Policy”, which you have duly read and fully understood. You acknowledge, agree and give consent to the Company and its officers, employees, service providers and agents may use, store, process, disclose, transfer and / or exchange your information (including personal data) in accordance with the Company’s “Privacy Policy”.

You are responsible for maintaining the secrecy of your passwords, login and account information. We will assume that you are using our website/ mobile application whenever anyone accesses our website/ mobile application using your password and login information (whether with or without your permission). You will only use the website to search for and to apply for loans for bone fide purposes and will not use the website to make any fraudulent applications.

The Company expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy, as well as all warranties arising by usage of trade, course of dealing, or course of performance. The Company disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the website and/or any other Services.

ASSIGNMENT

ARBITRATION AND GOVERNING LAW

The laws of India, without regard to its conflict of laws rules, will govern these Terms. In case of any legal action courts located in Bangalore, India will have jurisdiction over such matters.
